Happy Kingdom Playground ( Operating under Nations Fresh Foods) , their agents, owners, officers, affiliates, volunteers, participants, employees, and all other persons or entities acting in any capacity on their behalf.

By signing this waiver, I am giving up my rights and the rights of my spouse and children and wards to sue Happy Kingdom Playground, Nations Fresh Foods for any injury, including paralysis or death, caused in whole or in part by the negligence or fault of Happy Kingdom Playground , Nations Fresh Foods.

I further grant Happy Kingdom Playground , Nations Fresh Foods the right, without reservation or limitation, to videotape, and or record me and/or my child(ren) and/or my wards on closed circuit television without compensation to me or my child(ren).

• I represent that I am the parent or legal guardian of the Participant(s) named below or I have obtained permission from the parent/legal guardian of the Participant(s) named below to execute the agreement on their behalf
• I acknowledge that my participation in Happy Kingdom Playground entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties.
• I , for myself and the Participant(s) named , willingly assume the risks associated with participation and accept that there are also risks that may arise due to OTHER PARTICIPANTS, which I also willingly assume.
• I agree that the Participant(s) named , and I shall comply with all stated and customary terms, posted safety signs, rules, and verbal instructions as conditions for participation in any play event, parties, or activities at Happy Kingdom Playground, Nations Fresh Foods.
• I , for myself, the Participant(s) name, our heirs, assigns, representatives, and next of kin agree to hold harmless, release, waive and indemnify the independent owner(s), members , their predecessors, parent, subsidiaries and affiliates, officers, equipment manufacturers, employees and sponsoring agencies from all liability for any such injury, disability, death or loss or damage to person or property to the fullest extent of the law.
• I additionally agree to indemnify the independent owner(s), members, their predecessors, parent, subsidiaries and affiliates, officers, equipment manufacturers, employees and sponsoring agencies for any defense cost or expense arising from any and all claims , injuries, liabilities or damages arising from participation in any play event, parties or activities at Happy Kingdom Playground, Nations Fresh Foods.
• I am of physical ability to participate and am legally competent to understand and complete this agreement. I hereby execute this agreement without coercion.
• The invalidity or unenforceability of any provision of this Agreement shall not affect the validity or enforceability of any other provision of this Agreement, which shall remain in full force and effect.
• I agree that if any portion of this agreement is found to be void or unenforceable , the remaining portions shall remain in full force and effect. If there are any disputes regarding this agreement, I on behalf of myself and /or my child/ward here by waive an right I and/or my child ward may have to a trial and agree that such dispute shall be brought within one year of the date of this Agreement and will be determined by binding arbitration before one arbitrator to be administered pursuant to the Arbitration Act (Ontario), I further agree that the arbitration will take place solely in the Province of Ontario and that the substantive law of Ontario shall apply.
• I acknowledge that I have read, viewed or heard the rules governing my participation and /or my child/ward’s participation in any activities at Happy Kingdom Playground, Nations Fresh Foods. I certify that I understand and have explained the Happy Kingdom Playground Rules to my child/ward. I understand that Happy Kingdom Playground Rules have been implemented for the safety of all participants at Happy Kingdom Playground, including myself and/or my child/ward. I acknowledge that failure to follow the rules could result in the expulsion of myself and/or my child/ward from Happy Kingdom Playground, Nations Fresh Foods.
